A question for all folks. I am an O1 visa holder with a valid visa stamp. My 140 is approved and current and I have applied for 485/131/765. My question is that since O1 is a work visa and dual intent like H1/L1, after filing for AOS, can I return showing my valid O1 visa stamp and continue to work on O1 or do I have to carry AP and EAD with me so that at POE, I have to enter using AP and continue to work thereafter on EAD. Pls help. Have asked attorneys but not hearing anything concrete. Anyone's personal experience would help greatly. Thanks in advance.
To Tipotodo: Any idea what is the travel arrangement like after filing AOS. You are the only one in this forum, I know, who is in the same boat as me: o1 visa holder, EB1, EA and has recently applied for AOS. My Attorney says it OK to use valid O1 visa tamp to travel in and out of country and continue to work on it even after AOS. He however mentions that if I use AP to enter, I have to have an EAD card and use it to work thereafter. Can u bounce it off with your attorney to reconfirm? Thanks.
