Traveling While Change of Status is Pending (08-23-2001)

I think it might hold true with visa categories other then H1B. I am not sure if H1B/H4 is the only category or not but am sure that H1B/H4 is dual intent visa and hence this rule does not apply to people travelling ( on H1B visa ) and have filed 485.

Can more exprienced people on this board comment on what I have stated above ?

I think we need to get more details on this, which Visa categories will be effected. I will discuss this with my attorney and post more details.

This has always been the case: if you travel out of the
country while a petition of change of status is pending,
the petition is considered abandoned, because you will
have two different I-94s, one attached to approval notice,
one obtained when you re-enter.

The rule applies only for "change of status" such as F1
to H1, it does not apply for AOS.
