Traveling - Please Help!!!!

Friends,

I am leaving for my home country this weekend. I have an
valid H1 visa stamped on my passport and this visa expires
Sept 30, 2003. I have an new H1 approval with expiry date of
November 2004. I am coming back to the US during last week
of August. Will i have any problem since my current visa expires
Sept 30.
All responses would be highly appreciated.

You can use your visa to seek entry into US until Sept 30. Your authorized period of stay will be based on your H1 approval notice period (Nov 2004), not visa expiration. You should have no problems at all.

When he enters using his visa which expires in sep 2003 - wont his I-94 be stamped with a validity date till sep 2003?
So, after sep 2003 - as his latest I-94 will expire - wont he be out of status?

Or can he get a I-94 at POE based on the H1 approval he has till Nov 2004?
 
He can (and absolutely should) get the I-94 stamped with the date on the approval notice and not the visa expiration date.
