I have valid H1 till 2005. I plan to go to India while my I485 is pending approval. It might get approved while I am in India. Can I get back in based on my H1 stamp in passport? I dont have EAD or AP. My lawyer told me that is possible. But I have heard that once I get approved I am no longer in H1 status and I need AP.
