Background:

(1) Aug 2000: Entered USA on H4 visa

(2) July 2003: Went to INDIA. Got a new H4 visa stamped valid till Jan 2005. At the US airport got I-94 valid till Jan 2005

(3) Dec 2004: Went to INDIA. Had an H4 approval notice till Oct 2005, but could not get it stamped due to time constraint. While entering USA got an I-94 valid till Oct 2005. (may be the officer cross verfied it with my spouse's H1 visa )

I have to go to Europe for 1 week in May 2005.
My question is:

(a) Will I have problem in entering USA since my H4 visa (stamped in passport is expired),
although the I-94 is still valid.

(b) While entering USA what is important valid I-94 or valid stamped visa in the passport
or both.

Any replies will be helpful for me to go ahead with my travel plans or cancel my trip.

Thanks.

You have no visa to enter the country. Don't travel.I-94 gives you the valid/legal status in the country. Visa is needed to enter the country. When you leave they will take the I-94 at the airline ticket counter then what do you have to enter the country????
