travel with pending AP

Hi All,

I have a H1b valid visa stamp in my passport until august 2004 and my AP filed on dec 03, 2003 and still pending.

Will there be any serious consequences if i travel on H1 visa with AP pending.

Does anyone know, if we travel with AP and vaid H1 visa with I-94
what are the documents we have to submit before we leave the US airport?

Also what are the docs we have to show them at the time of entry to the country?

I am planning to travel without AP, but also have a valid H1 visa with I-94. do I have to use the H1 docs anywhere on my travel?

If you can get back to USA atleast 1 month before expiry of your stamped H1 visa (not I797 dates) you should not have to worry about anything

Not that I know of. It is upto you whether you want to use a visa or AP. Since it is pending and I guess you would not get the actual AP document for another 2 months, it would be wise to use the visa.

All you would need to give is the I94 document. They do NOT care whether you have a valid visa or not

Since you have a valid H1 visa stamped in your passport you will show your visa and if asked I797. (but it is safe to keep 2 recent pay stubs, latest employment lettter indicating that you are employed in a full time permanent position, other H1 related documents if any)

If you do not have AP, there is only 1 option for you i.e. to use H1 docs.
