Can somebody please explain why travel on A.P is risky.

Here are my questions.
1. I am living in this country for almost 4 1/2 years and i had almost paystubs and W2's for all these years except for the first 3 months after coming to this country and my consultant didn't ran payroll for me until i got the job. Does this effect my travel?.

2. My H1 visa stamp is going to expire this month april,30,2004.
My lawyer filed for extension and i just the recipt number and still waiting for approval., if i get approval it will take atleast 4-5 months inorder to send my passport for visa revalidation. what good does it make if i have A.P , can i still use my H1b visa for travel?

Here is my thought.

1. Not having paystubs for initial 3 months does not matter.

2. If you have bothe AP and valid H1 visa (stamped on your passport), use H1 visa, even though you can use AP. Be on H1 as long as possible.

1. May affect - no point in taking chances - it is zero tolerance policy nowadays.
2. Yes you may use H1b for travel even though you have AP in hand.

Also do yu have to give the physical AP paper to the immigration dude/dudette when you enter US?
 
I checked with my lawyer on this and he said one can travel on AP, but must return before the expiry date of the AP. Using AP does not negate H1 as per several memos issued by the USCIS.
 
I would vote for using H1 if you have a valid VISA... If not, and you don’t have time to wait for stamping in passport, I would use the AP if I were you...


Just to let you know, one of my friend went to India and came back last week and he said that the immigration officer made him to wait for over 2 hour at the port of entry to verify his 485 and AP documents in their system. He was frustrated and said "Damn... I should have used my valid H1"..
 
Recently my wife went to India and came back on AP. The port of entry is Atlanta. They did not ask her any questions. She carried all the documents. They just looked at the Advance parole and wrote "Adjustment applicant 485" on the I-94.

Yes. we need to give the Original AP at the Port of entery . They are going to put a stamp on it and give it back to us. And the Date on I-94 is Oneyear from the entry date.

If they stamp the original AP at the port of entry, then can we use it again when we need to travel abroad( assuming AP has not expired)?

I have AP till 2004 end. I have already travelled to india by January 2004 using the AP. I might need to travel again soon, can I use the same AP? if yes, what other documents do I need to carry?

I have different case in here..!!

1) First A.P valid from July'03 to July' 04

2) Renewed A.P valid from July '04 to July '05.


The question is , Can I use first AP to leave U.S in June '04 and enter U.S with renewed A.P in Sept '04 .??

Anybody has answer ??

You don't need to leave US using AP. Nobody checks AP(or other visas) when leaving US.
You need to show AP (or other valid visa) while entering US. At that time you have to use whichever AP is valid.

I used my AP to enter US 2 days back with POE as SFO. No questions were asked and I was out in minutes.

My case: Valid H1 but no H1 Visa stamping in passport.

Infact I have a similar scenario and after reading this I postponed my travel.

However, I think whatever Abhi said seems to be reasonable too..
I also wonder, how would they know which AP was in effect when we traveled outside...etc

But again, why take risk...(unless it's totally unavoidable).

Only tell about genuine cases , no brother of friend who is freind of my sisters friend who lives close to my friends friend, you know what i mean.

Here are my answers:

There is grammatical mistake - you can travel thru AP not on AP. But anyway it is not my job to fix typo and grammatical errors. I am here to tell you about risks involved.

1. AP is good place, risk is minimal unless you travel thru naxal areas. For them having W2, salary slip etc will not matter.

2. I am not sure if they would like to see your approved H1b papers, but keep it. If they take a look at it - let us know.
