Travel while AP renewal pending but current AP valid

Hi Gurus,

Question for you. My current AP is expiring in Jan 2004 and I would be applying for a renewal soon. Can I travel out of country, say in October, while the AP renewal is pending, and re-enter using my current AP.

Yes you can use your current AP to re-enter as long as its not expired.

Am not sure if the next AP would be valid if it gets approved while you are away.
Check and make sure about this ....

If you don't foresee another international trip immediately after this one, why don't you apply for renewal after you come back ??

Thanks max2k1 - unfortunately, i may have frequent international travel coming up.

Anyone else has any ideas about the current/next AP's validity in such a case?

This was clarified in a USCIS memo a while back. Provided you leave the US with a valid AP and return using the same AP then you are perfectly OK, and any renewal AP issued during your absence is perfectly valid.

The basic rule is that the AP you intend to return with must be in your pocession at the time of departure. It is not allowable to have a valid at the time of depature but then return after its expiration date using a new AP that was approved in your absence.
