Travel to India with --- Pending I-485

Hi all,

We applied for I-485 two weeks back. So, was of the impression will get EAD,travel doc in 3 months. but the dates updated recently are very strange. they went back by couple of months. now i think it will take more time to get EAD,travel document too.
So, my question is, due to personal reasons i should stay in India for 5 months. Is it ok to travel when ur 485 is pending and to stay out of the country so long?
I am waiting for finger print receipt, do my fingerprinting and then travel.i have a valid H-4 visa . we have office in India, so i can work from India.

Well, you can definitely stay in India for 5 months while your EAD and AP are being processes as long as you have a valid H1B to come back. As regard to FP, that can be a bit dicey as you never know when CIS can send a FP notice, and even if you had someone monitoring your mail, the window they give to appear for FP is quite small and you may not be able to travel back in time to appear for it. Failing to appear for FP can be quite deterimental to your AOS application.

One of the way around is to have someone check your postal mail everyday, and if FP comes in there is a very simple way to ask for rescheduling it, that may buy you a few weeks but not more.
