Hi Guys,
My wife is travelling to India on 14th of this month on Advance Parole.
But today we received her I485 approval notice and i am unable to get an appointment for I 551 stamp through infopass for a date earlier than 14th.

Would she have problem at the port of entry while returning to US if she travels without the new stamp (using only Advance parole) ?

I managed to get an appointment on 17th, so can i go earlier and request them to stamp her passport early explaining this case.
We cannot postpone her trip due to some emergency.

Any suggestions

I had asked the same question to my lawyer, and my lawyer told me specifically *not* to travel *after* approval *without* stamping, saying it could create issues at port of entry and said its not worth taking the risk. ( maybe its considered as abandoning of the AOS ? )

AFAIK, San Jose office is strictly InfoPsss only, if anyone knows how to get emergency appointment please post.

If I were you I will try taking the approval notices along with the air tickets and any other proof/document that will support the emergency of the travel and try to get an appointment by pleading with the security person at the gate.

I don't agree with tonymontana (although I might not be correct) - I know of multiple people who have used their AP to travel after their 485 approval and before their 551 stamp. You will be given deferred inspection at the POE and asked to go get your PP stamped.

Keep in mind I am not a lawyer - this is my opinion. Don't take your trip based on this posting - Consult someone who gives this type of advice for a living.

Attorneys always try play safe and that makes sense too.
Getting stamped before leaving USA is good idea. Also, you will be able to stand in citizen/perm resident line, which is very short in most of the POEs. But if you cannot get stamped - that's not end of the world.
I don't think INFOPASS will work for you. Try to go to USCIS office walk-in with your approval letter and flight-tickets. If that does not work out, don't change your flight plan. Go ahead with your advance parole. Your entry won't be denied.

Why Don't you postpone the air trave by 4 days ? It may cost you couple of hundred bucks But saves hassel & Worries !

my two cents
