travel to India on AP via France

Hello Everyone,

How safe is it to travle to India via Newark(NJ) to Paris to Delhi on AP when H1 extension is pending?

Do we need transit visa in Paris?

do you have EAD? I think that if you have EAD then no problem. when is your H1 visa/approval getting over? Is it the 7th year extension?

I did travel to newark via paris last week. I need not have to get an transit visa. I was travelling using my AP with an expired visa in my PP.

However check with your Lawyer... I think it is NOT a good idea to travel will H1 extention is pending, because you would have furnished your 1-94 details while submitting you extension papers. So i-94 number will change when to come back to US again. You will have to do some more paper work after you come back.. Its a pain. I did go though this once.. check with your Lawyer..

1)Now I seem to be traveling to India via Amsterdum. Do I need transit visa? I am flying by KLM. My travel agent has said I don't need transit visa in Amsterdum.

2) What is the procedure for using AP at USA port of entry while leaving USA and as well as while coming back to USA?

I am little worried about pending H1 extension. But I did travel to India before when my H1 extension was pending. Since I am travelling on am emergency, I can't help.

I-94 number doesnt change

although my knowledge is limited to one exit only, when I came back the officer wrote the previous number (the i-94 no that i had previously) on the new I-94 scartching the original number out. I never had a different number.
anyone with different experience.
also amsterdam doesnt require transit visa. Paris according to some does and according to some doesnt.

I am not sure about Amsterdum. But I would suggest you check their web site for more information.

You dont need to do anything while leaving US. All they are going to do is pull out your I-94 from your passport (as usual). But while entering US, The immigration officer at the POE will place your PP, AP and I-94 form in a folder and send you to a immigration office. where you will have to wait for a while and they will call your name and clear you out. Its hassel free. It just take a little bit of wait. It took me about 20 mins at Newark. Keep multiple copies (photo-copies) of your AP handy along with your original.

I checked mine now. I-94 number is different ( than what I had last time) with a seal saying that " PAROLED until xxxxx" and POE info.

As far as I know, 1-94 number changes every time you re-enter US. It was that case with my experience.

I am curious to know where did the officer at POE find the previous i-94 number? They should have taken it while leaving US.

Joejoy, They have your I-94 number in their computer. I think they keep I-94 # same as long as you stay in the same visa. My I-94 # is same since I entered US. As you became parolee after you use AP, your I-94 # may change as youu are changing your status now.

I have a question. you wrote "paroled until xxxxx" .....is this xxxx is the date until AP is valid? how do they define the duration of status in this type of cases?

JJ, which airlines did you travel by?
I am in the same boat as you. My H1 stamp has expired (but not H1 visa), and I have AP. I am traveling next month by Air India. Will they give me trouble if I show them the AP, and do not get a transit visa for France?
My wife's H4 visa stamp is valid till the end of month and she is coming back in the first week of the month, is that going to be ok or will she need a transit visa? (She also has AP).

Interestingly, The date is one year from the date I entered US, but AP is vaild only for next six months.. So Date has nothing to do with the validity of AP... I am not sure if this is a problem.. I guess not really concerned about it for now...

I did travel Air India. They are one who suggested me to travel via Paris to get around with the transit visa mess. They know the rules well. But they ask for a copy of AP. So make sure you have a photo-copy handy, othewise they are going to take one of your originals.

If you are travelling via Paris, then no transit visa required. But Londen will need a Transit Via..

Call up the Airlines and reconfirm again.
