hello,

my wife and i are going to aruba in may 08 for tourist purposes. i working on h1-b and received my EAD card. GC is still pending. My wife is working on EAD card. I do not have a current H1B visa on my passport. my lawyer suggested that if i am going for less than 10 days i do not need visa to come back. is it true? also the lawyer suggested to travel on h1b rather than using advance parole. please let me know if this is correct.

thank you,
sam.

You can use your AP. We just got back from mexico yesterday with no issues.
We are in the same scenario as you are.
PD : APRIL 2002.

I traveled to Aruba in January for my brother's wedding. I returned using my AP without any problem. If your H1B is expired and you need to renew it, you cannot return without doing this evenif you've been out of the US for 1minute.
