Hi Gurus,
I need some advise/your experiences towards travel: My current 6yr H1 term expires soon. My current employer has applied for I-140 and I-485. I got the receipt notices for AP, EAD, and I-485. My company has also applied for 7th year extension and will be getting it soon. Now I want to travel to India and when I come back I will have only one week of valid H1 term left behind. Will this pose a problem at the port of entry. Can I travel, and if I do so, what are the documents needed at the port of entry?

To return you should have the following:
1. A valid visa AND a valid H1 approval notice, OR
2. A valid AP.

If you have only 1 week remaining on your H1 AND do not get 7th yar extension by then, you will be allowed I-94 based on H1 for only 1 week. After that you use either use EAD to seek employment or use H1 extension receipt notice to continue working beyond H expiration. (I don't know if there are possible complications.)

I have another question, what will happen to my I-485, should I have to apply once again since my old I-94 number will no longer be valid. When I come back I will be issued a new I-94. Does any one had ever faced such a situation.

If only one week is their on your passport Their can be a problem. You need to go for stamping. You can do premier processing or use your AP to get in.

Better talk to your Attorney.

Thank you for the response. I will be having my H1 approval by then. Should I have to get it stamped or it is just enough to show a valid visa and an approved H1-B notice at the port of entry.
