Hi All,

My I-485 is still pending (RD 11-5-01 ) and my company is sending me overseas for a business trip (probably 3 weeks). My H1-B will expire 2-10-03. My questions are..

1- Do I need an AP to get back to USA?

2- Am I going to go through the new regestration system? Can some one share his experiance regarding the new regestration.

3- What is the list of papers that I should take with me?

4- When INS Say "... Nationals and citizens of bla bla bla..." What is really the difference between Nationas and Citizens.... is being born (just born there and left when was about 2 years old) in one of those countries in the black list makes me a citizen or national?

5- Should I tell my company that I cant do it and wait until get GC approval.. (that will make me look bad)..

AP is required for U to travel outside the USA when your
I-485 is pending. Valid H1 is Ok also to travel.

Travel in AOS

If you are planning to return to USA before the expiration of your H1 (02/10) you need not have to have AP to enter. If it's later you must have AP to enter in to USA.
As you mentioned it's only for three weeks, you will be OK. But, please carry your I-485 notice along with the letter from your employer.
 
Talk to your Lawyer

My wife and I travelled outside the US and returned on valid H1/4 visas while our I-485's were pending. Our 485's were approved while were travelling we had no problem getting back in. We had no APs and were not asked any AP related questions. In your case since you have a short duration till your H1 expires ( ours are valid till Sept 30 2003 ) you might want to talk with your lawyer. You might also want to carry proof of your status beyond Feb 10 when your visa expires (H1 extension/ EAD) and possibly a letter from your company about your employment going forward.
Talk to your lawyer and make sure you take his phone # with you in case there is any problem. Happy Journey
 
you can use your valid H1 to re-enter as long as you are not working on EAD. Otherwise, you need to have an AP.
