My H1B (and my wife's H4) three year extension of status has been filed by the company
Our current H1B and H4 status is valid till October 2006. Both have stamped visas till October 2006
Is it ok to travel to India while our extensions are pending? We intend to travel and return in the month of August. I am asking this question because I know that change of status (COS) is abandoned if one leaves US. Does this also apply for extension of status?
My EB1OR I140 is pending (got RFE and response sent), our I1485 pending, our AP and EADs are approved. However, we want to maintain H status by not using AP or EAD till any positive development on GC
What do you guys suggest?
