Travel On AP

I currently have a pending I-485 application. My I-140 has been approved. I changed jobs and sent AC21 to INS but I-485 was denied in error. I applied for MOTR and case is reopened and is pending. Is there any problem with travelling on AP? I do not have a valid H1B anymore. What documentation do I have to carry for POE? I will be enterting via Chicago.

You should not be having problems during reentry provided the following are taken care of:

  1. All the receipt notices and approval notices of I-140, I-485, I-131, I-765, etc.
  2. Any kind of correspondences like your AC-21 notification to INS, filing of MTR, acknowledgment of reopening of your denied case by USCIS, etc.
  3. Proof of a pending I-485 is ineluctable to your reentry. This is the reason you will have to have a peremptory letter/notification from USCIS clearly indicating that the case is reopened and is under purview for adjudication.
  4. Pay-stubs.
  5. Employment verification letter.
  6. Documents to vouchsafe for the international travel.
  7. EAD document to prove that you will be employed with the same employer or a different employer under the same category until Adjustment of Status application is approved.
