Travel on AP

Hello Guys,

Need your help. My wife wants to travel to India on EAD/AP. Her H-4 is expired. Can anybody share their experience on traveling on AP.

Only problem is, she doesn't speak much English. Would they take her interview or something??

No questions asked while leaving the country. But when coming back all AP people are almost always have to go to secondary inspection. At some airports they don't ask any questions but at some places they do. There you can expect questions like... Is the primary still working for the company which filed GC? etc. If yes no problem. If not, you have to tell them that you are using AC21 so you can change employer once 180 days passed after filing 485. No need to fear but simple questions can be asked and you need to prepare your wife for that. Have fun.
 
If she is travelling through Europe (especially UK), then she would need a In-transit visa for UK, especially when she returns back from India. I would suggest you should check with the respective country's consulate and also with the Airline.

We had to take an In-transit Visa for UK to travel to India while on AOS and H1/H4 Visa was not valid and were travelling on AP.

In most of the Airports in US, they do not ask too many questions, you would just have to give your PP and AP and they can scan it and will know all the details and would stamp the original and take a copy of it and give you the original. You might have multiple copies of AP, but do not give all the copies to be stamped, just one AP is enough.

Some airports do secondary checking (like SFO). There they can ask questions. On the other hand, I and my wife used AP in LAX and we never had any secondary checking. As she does not speak much english, it's better to provide enough document so that she does not need to speak. Prepare a nice and neat folders where you can provide following documents:

1. copy of her I-485 receipt
2. copy of your I-485 receipt
3. copy of your passport (main pages)
4. a business card of your lawyer (if you have one)
5. latest tax return
6. your recent paystubs
7. copy of your EAD

Also she should keep DL/DMV photo ID, EAD with her.
