travel on AP - pending AOS

Folks,

I am currently on H1B (no stamp in passport) and changed from F1 to H1B. Now my I-485 is pending.

I plan on visiting India on AP. Do I need a H1B stamp in the passport to be able to use AP. Am I fine with just using AP to return?

You don't need a H1 stamp to use AP. That's one of the best reasons to carry AP when you travel :)

You can enter by just using your AP (& passport) -- also after entering on AP, you'll continue to remain in H1 status (if that's important to you).

You also don't need to carry the huge a$$ pile of H1 docs either .... take a copy of the 485 notice if you have it -- else no big deal.

Thanks much for your reply. Now, that you know better than I do, let me ask another question.

If my wife (on H4 status - no visa stamp on her pass port also) wants to work can get her EAD for her to work while I continue to work on H1B?

Hope she can also use AP to travel just same as mine and we don't need to visit the consulate for VISA stamp.

Your wife can work on EAD, you can work H1, and yes... she can also travel on AP...
