THis is an urgent inquiry.
I am traveling to Europe for work in two weeks.
I am currently on 8th year extension for H1B and got it extended for 3 more years (through 2008) based on visa number availability.
I do not have H1B visa stamp and so I will re-enter on advance parole. My 485 is pending.
My question is:
If I re-enter the country on advance parole, and then marry a girl in India in the next few months, can she come here on a H4 dependent visa? Or does the fact that I will be paroled into the country make me a parolee and will not allow my spouse to enter on H4 visa based on my valid H1B status for another three yrs (but no H1B visa stamp in passport). Can you please let me know as soon possible. This is an important personal decision for me.
