Travel during pending H1 transfer petition, after Sept. 11th

My H1 transfer petition has been filed with the CSC. While the petition is pending and while in my new employment, I may be required to travel out of the USA. My old H1 is valid well into 2002.

Will the transfer petition receipt, letter/paystub from new employer and my old (valid) H1 stamp be sufficient for re-entering the USA, especially after September 11th ? Could someone help here ? Any personal experiences ?

Thanks for this posting -- i\'m in a similar situation travelling while h1 transfer is pending and had been trying to get information about the travel for a long time.
 
Lawyer\'s advise not to travel

I\'m in the same boat. I\'m planning to go out of US while my trnasfer petition is pending. I spoke to couple of lawyers, they say technically you can travel with the receipt in your hand with a valid H1 stamp on you passport, however, after Sept 11 , INS may ask you series of questions at the port of entry. I\'m also confused what to do.

I just returned to US on an H1 transfer receipt notice. At the port of entry the officer asked me about my I-797 and i told him my petition was still pending and showed him my INS receipt notice (original). No problem. I was also carrying a letter from my current company just incase but he did\'nt ask for it.

(BTW my entry was at Detroit if that makes any difference)

I have one question, while your I-129 is pending and you travel,
doesn\'t that nullifies your I-129 petition, i.e. one needs to
file again..for H1-B extension (EOS) ? I\'d VERY much
appreciate a quick reply ?

I am on an H1-B that expires on feb 18, 2002 (also
the I94 card in my passport). The H1B-extension was
filed on sept 25, 2001 but has not yet come through.
Now I am leaving US on dec 11, 2001 for a month to India.
Could there be any problem when I re-enter the US on
Jan 8, 2002 ? I mean my visa would be expiring in a month
and the immigration-officer might not like that fact. Also
if my extension is not approved before I leave on dec 11,
2001, does that mean, my application is null and void and
I\'d have to re-file for H1-B extension ? Could someone
please provide some help/info in this regard ? I am
very anxious and if I need to change my travel plans then
sooner the better.
