Travel between Interviews

Hello,

My parents had the interview for citizenship. The officer pointed out that they had travelled overseas quite a bit (even though they took the 2 year permission). He asked them to bring additional documentation regarding the travel abroad and asked them to come back for a retest in a couple of months time (date to be sent via mail).

Can they travel for quick trip abroad in this time? An emergency has come up and they would like to travel.

Thanks

You didn't provide enough information for anyone to say what their travel situation is likely to be.

Natz eligibility rules require an applicant to have a minimum of 900 days physical presence in the past 5 years, as well as no single absence longer than 6 months. In addition, there are unwritten rules which make it difficult for someone to be approved if they have taken back-to-back long trips which make it appear that the person was residing outside of the US.

There is also the issue that simply having a valid reentry permit does nothing to help preserve continuous residence for naturalization purposes. The only method of doing that is either through an N-470 (difficult to obtain) or military service.

So in summary, I'd say that unless your parents have already broken their residence, or are very close to the physical presence limit, they will probably be fine to travel for a short period.

Additional Details...

my parents meet the 900 days criteria. though they have absences for 6 mos or more at a stretch.

Oh, well hopefully they weren't back-to-back trips. If so, they better start investigating the 4yr+1day rule.

With single trips over 6 months, the burden of proof rests with the applicant to demonstrate they maintained close ties with the US, and did not do anything to demonstrate they had abandoned their US residence. Its and uphill battle, but possible if they can provide sufficient evidence.

Aww crap, just realised I hit the wrong button and edited your reply. THAT WAS NOT WHAT I PLANNED TO DO. Sorry.
