Travel before AP Approval

It took 8 months for approval after applying for AP in TSC.

What if we travel before AP is approved and enter when we get approved AP? Are there any drawbacks? What happens at POE?

Please help.
 
Understood. But what do we do if we have to travel when AP processing takes 8 months and emergency AP is given only in case of dier urgency. What we consider as an urgency is not always accepted as emergency by officer.

Please help.
 
Avalon, You are right. Better talk to INS customer service.

Better talk to INS customer service.
It is ridiculous, if takes such a long time like 8 months for a travel document.
You keep on calling them.
You may consider talking to a senator or congressman.

If you are on H-1 then this is what the note says on this website.

Note: Aliens holding valid H-1 (temporary worker in a specialty occupation) or L-1 (intra-company transferee) visas and their dependants in H-4 or L-2 status who have filed for adjustment of status do not have to file for Advance Parole as long as they maintain their non-immigrant status.

So I guess if u have a valid H-1 visas, u can travel w/o AP approval. This is my suggestion. Any other advise suggested as my wife is out of USA and we have applied for I140/I485/I131?1765 in Oct 2003. We have recv'd EAD but no AP yet. My lawyer told me that she can go to US consulate and get her H-4 extension as I have my H-1 extension till 2006 but my 1st H-1 visa has expired. So she just have to go for H-4 stamping.
