Hi

My wife's AP approved after her depart to INDIA?

Now...Can she travel with that AP?

Because everybody is giving diff opinion..like she can come or not come....

I also spoke my attorney..she told it should be fine.....

Any of your friends or known people travelled with such kind of AP...(approval after depart US)

I would really appreciate your help on this.

She cannot use the "AP" that was approved during her absence. Your attorney is wrong. Is he an Indian attorney who just finished his law school. This is a basic thing which most of us in this forum know, and I am surprised how an attorney can misguide you.

Dont take risk in showing the AP at the POE. If she has a valid stamp, use that to re-enter. Good Luck

Attorney Murthy : As explained above, there is a risk since the CBP is allowed to deny entry to a person who attempts to enter on an AP approved after s/he already departed the U.S. The only option is for that individual to enter on the AP previously issued before that expires, to avoid being stuck at the border or being sent back on the next flight.
