Travel after I-140

kktk

I just got my I-140 approval. My H1 is on the 8th year and the lawyer will be filing for a 3 yr extension. I have to wait a while before my prioirity date becomes available.

What, if any, is the restriction on travel?
Or does that only apply when the I-485 is filed?

get a new H1B stamp

Since you can not file your 485 and hence the AP you need to get a new H1B stamp to get back into US. Wait until your h1b extension is approved and travel.

Oh OK...thanks I knew that part. My current H1b doesnt expire till March 07 and the extension is being filed for right now.

I was concerned about after the H1b gets extended(for 3 yrs this time), is there any travel restriction or there is no change in that aspect once your I-140 is approved?

Travel using AP and maintain H1

I am on 7th year H1 extension and I need stamping to travel.
However, since my PD is current, can I use Advance Parole to travel to come back and file H1- Extension.

Or
If one uses Advance Parol, then H1 status cannot be maintained?

I want to maintain H1 status till I-485 is approved.

Experts Please advise.
