Transferred to Dover AFB,De - please advise

Hi
My husband's co applied for his labor from Delaware ( EB3) although he his project at that time was in NJ ( he is a consultant) and we were living in NJ too.At that point his company was based out of DE but they have expanded by now and they have a NJ office too. However on his paystubs he still pays DE taxes although we live in NJ.

We had our fingerprinting last Nov in Newark,NJ and got our 2nd EAD and AP also from Newark, NJ ( applied online for this).

Today we got a email saying both mine and my husband's cases for 485 have been transferred to Dover AFB local office in DE, for further processing and we should wait to hear from them. We are very concerned as we are not AC-21, have always been legal and never out of status , and my husband is still working for the same employer who has filed his GC.

Why then have we got this interview? Also why in DE and not in NJ- could it be cause the labor was filed there - is this normal?

Any insight is appreciated.

I think there might be a change of address involved on your records and usually they transfer to local office due to various reasons such as QA, Verification, Change of Address, Medicals etc.

Checkout with Delaware office to see what cases are they processing. All you can do is to wait and watch.

Good Luck! Once the case is transferred to local office, you cannot call VSC anymore.

My case went through the exact same thing on 22nd. I requested a change of address and thereafter I recieved email this monday that the case has been transferred to DOVER AFB. I tried seraching for this topic and it led me to this thread.

WantGCSoon (or anyone knowledgeable): The date on the USCIS website for DOVER office, is that the date the application was filed at VSC or is that the date the application was recieved by the DOVER AFB office ?

I also have to file extension of AP/EAD. Should I now wait for the transfer notice and file with Dover AFB office or can I go ahead and file in VSC ? I am so confused now....

Hariya,
You need to check for the local office processing dates. VSC processing times are not going to help you from now on. If you want to apply EAD/AP, you need to apply ONLY at Chicago Lock Box office for local office transfers.

I checked the USCIS website and they do not mention employmnent based EB3 category as the ones who have to file at the lockbox:

Also, I checked the dates for the Dover office and they show currently processing I-485 with a date of May 21/04. What is not clear is whether that date represent a cut off for applications filed at VSC on or before May 21/04 or applications that were transferred to transferred to Dover on or before May 21/04. There is huge difference between the two since mine was filed on Aug 9/04, but was transferred to Dover on Aug 22/05

I have checked in NJ that once local office transfer is done, we need to file only at Chicago Lock Box office even though this office is purely for family based petitions. You can take my word for it. I have applied EAD and AP and got the same without any issues.

You need to follow as when they are processing the cases in Dover if they show 21/04, that means that they are processing cases that they received on these dates and before.

Transfer sucks.

Your q at the local office starts when the file is received by them, and not when it was received by VSC. If they are processing May '04, then they will reach your file >12 months from now. In the midwest and in RI, and ME the local offices have much shorter wait times.

Thats the strange part - we havent done a change of address yet and also we had given our 485 processing local office as Newark, NJ. I wonder just because the labor was from DE they have sent it to Dover AFB ? Lets stay in touch so that we can help track each other dates/progress.

Our lawyer is frankly not very competent and is not able to give us any answers, infact he says this is not an additional delay where as its obvious this is a 1+ yr wait :(

Some questions - we actually plan to move after 3 weeks( within NJ itself), where should we do a change of address now that its with the local office ? With VSC and also Delaware?

Also we have AP valid till April 2006 so if we plan to visit India during Dec timeframe do you think we will anticipate any problems ?

No idea why they do this at all. Staying in touch: If you want you can private message me if you have any more info/updates, and I will do the same to you as well.

I changed addresses while it was still with VSC. However I still have not yet recieved any formal notification, just the original email.

AFAIK, the visit using AP is OK as long as the date of entry back into the US is before the expiry date of the AP *and* there is no reason for USCIS to invoke the 3 or 10 yr bar on entry. I have used the parole in the past without any problems whatsoever.
