I have a labor certification under EB3 approved last July 2003 and my employer has filed the I-140 petition.
Succedingly my wife passed the RN exams, she was petitioned by her employer, and my I-485 (adjustment of status, as her spouse and derivative) was filed together with hers.
My question is: Can I request my would be employer to cancel the I-140 petition. What will happen to the labor certification? Can my employer used it to serve another qualified applicant?
