Transfer to a different state while retrogressed for 485 Approval

Is it okay to get transferred to another state if the status is waiting for 485 approval since more than 6 months. I-140 is approved.

What are the things one should be wary of in this case? Will moving from TX to CA increase the processing time IF we get out of retrogression one day? Is it advised to remain in the state where labor was filed? Does it fall under AC21 even if it is a transfer for the same sponsoring company but to a different state (same job)?

PD June 2000 - I-140 Approved - 485 filed in April 2005.

Green card is always for a future job. when your 485 was filed, the company employing you has made a "good faith " offer to employ you in a specific location
In this case since your 140 is approved and you have 485 pending for more than 6 months you can use ac21 and move to any location
Note that this has has to be for "same or similar" job.
In almost all cases the original service center will continue to process your pending 485 application so you should not be subjected to any additional processing delays because of change in location

hope this helps

Thanks Arbit! The lawyer I talked to told me that it will be transferred to the new service center. Could you please confirm if in such cases the original service center keeps processing 485?

Thanks ...
