Hi guys,

I got laid off last week and planning to join another company in Chicago. My 485 has been pending in California for past 2 years now. I have an EAD as well as H1. What I wanted to know is:

1. Which is the center for me in Chicago. Is it Vermont BCIS office?
2. How can I avoid the transfer of my case to new state ?
3. Is maintaining the CA address will help me. I would be doing an H1 transfer so the paystubs will be generated from IL state.
4. Whats is the impact on GC process if I move to another state.

Pls advise & help freinds

Thanks

Rahul

I am trying my best to answer

chicago comes under nebraska.
there is nothing realy one can do to avoid transfer except staying the place that one is. also that does not guarantee no transfer.
I think in Murhty bulletin this week, attny murthy mentioned that is is difficult to show that one stays in a particular state and works in another unless job is temporary. so its hobson's choice....say job is temporary>- means not a permanent offer. if permanent>- how can you justify staying in CA and working in IL.
I have seen a few posts like ksv and eb2_I485_RD0901 where change of state did not matter at all. check in AC21 forum also.
My view of course....check with a competent lawyer.
