Traffic Tickets (Non DUI) on N-400 - Why?

Hello:

I read a lot about mentioning traffic tickets on N-400 in the forum. My question is if it is non DUI related (e.g. sppeding or crossing red light etc.)? WHY SHOULD IT BE MENTIONED IN THE FORM AND UNNECESSARILY INVITING TROUBLE.

Nowhere it is mentioned in the Guide that you have to mention it. Just debating... and leaning on not mentioning it in N-400. I have only 1 speeding ticket that I paid fine and no charges filed.

Any comments ???

If you read the question in Part 10. Additional Questions D.16 on the N-400 form, it says:

16. Have you EVER been arrested, cited, or detained by any law enforcement officer (including INS and military officers) for any reason?

Even if you are just stopped for a potential traffic violation by a police officer, it means you have been detained by a law enforcement officer. This is no matter what the outcome of the detention is i.e., you may have gotten a ticket or not. So the answer would be "Yes" in my opinion.

And I am not sure what makes you think that you are inviting trouble by mentioning a routine (non-DUI) traffic citation on the N-400. Mention it on the form and submit proof that you have taken care of the citation by paying the fine, taking defensive driving etc.

sure the guideline does not mention you have to report traffic tickets.

however, you have to report the citation.

Since traffic tickets = citation, then you will to report the traffic tickets.

For example, guideline does not mention you have to report a jail walking tickets, however, if the jail walking ticket is a citation (since i do not know if a jail walking ticket is a citation or not, so i just leave the "?" here), you will need to report the jail walking ticket.

Traffic violations

I have read elsewhere on this forum, that Traffic tickets are not required. In fact, there has also been a posting of a person, who when declaring the traffic ticket was told by the INS officer at interview, that it is not necessary, and that it had now created additional work for the officer, to go to her supervisor for clearing this.

A number of persons have mentioned that traffic tickets are not required to be indicated. Has nayone asked the immigration lawyers if they have to be declared?

I went to the interview on June 10, 2005 and asked the CIS officer if he wanted to know about traffic tickets. Answer: YES! He listed all my traffic tickets (total of 3) on the N-400 and asked me if I had proof of final disposition. I had copies of all court records showing either paid or dismissed.

That's it. No big deal but CIS does want to hear about them.

Highlander,
Which District office? And did you list it on your initial application, or showed it at the time of interview only?
Thanks
