I used to stay in Birmingham AL, USA in 2005. I placed a ad
in local newspapaer around 6/15/2005 to sell my used car.
The car was sold on 6/30/2005 in a cash deal. I discontinued
the car ad and my insuranace on the car on 7/1/2005.
But I had forgotten to remove the car tag. The buyer had
mentioned only his First name and last initial on the Bill
of sale. Since I had got my money I least cared to follow up
the matter to get back my car tag and neither did inform DMV
to discontinue it.
I moved over to Kansas City in August 2005. During the move
I shredded off the Bill of sale. So now I don't have
complete name/ph/address of the buyer. There is no way to
track him. The only thing I know is his first name and last
initial and that he was from Birmingham AL.
Apprently seems that the buyer never registered the car and
still using my car tag. I realized this when I got a traffic
citation from Birmingham court on 3/15/2006 to pay the due
amount by 3/30/2006. The citation is based on car tag and
has been rerouted from my Birmingham address to kansas city
address. The tkt is dated 01/29/06 in Birmingham at which
time I certainly was not the owner of the car and neither in
Birmingham. It seems to be a parking tkt.
I spoke to Birmingham court person on phone and she has
asked to send a written explanation with a copy of citation
to the court, but does not guarantee that it will waive off
my name from the ticket and that I may still be liable for
the tkt amount due. The DMV is not ready to flag the tag as
void unless I go in person there. The tag will expire in
April 2006.
The amount is only $25 and I don't mind paying it but that
would only imply that I accept ownership of the car which I
am actually not. I want to avoid any further court
consequence (like a arrest warrant) on me for not paying the
amount due.
Please suggest what should I do? Pay the amount ? Appeal
the tkt ? Any other suggestions ? (It may not be possible
for me to go to Birmingham to visit the court).
