My tourist visa expires on Aug 3. The problem: my mother is a permanent resident who married a citizen. She is being naturalized, the ceremony is Aug 20. As soon as she becomes a citizen, she will petition for me (and my husband and son).
Should I attempt to extend my visa and wait until my mother petitions for me once she becomes a citizen? What happens if I do not hear from BCIS before my visa expires? Am I considered an overstay? and what can I do if extension is denied?
After she petitions for me, can we remain in the US with or without an extension or will we have to go back to Mexico? Will we be allowed back to visit while the petition is pending?
