Tourist visa, approved I-130

Hi,
can anyone help me answer my question?
I am here on tourist visa with approved I-130 and awaiting my visa number for applying for GC.
I am also attending college and I will get my degree this year. Is it wrong to study with tourist visa in here? My college know about my tourist visa and approved I-130. Would it make any problem with getting my GC? Should I tell them (INS) that I study here?

Because the risk is huge if something goes wrong, the best thing for you would be to consult with a competent immigration attorney.
 
Answering this question from a green card prespective, you have not kept to the strict requirements issued by your visa. To study in the US as a student you need to be on a F1 visa and not a tourist visa. That alone is grounds for a massive RFE, deportation and ban from applying for an American visa/ green card for any number of years.

After 9/11 the immigration officers have become extremely strict about implementing people entering the United States do no commit fraud on their stated purpose. (Something which you have done). Hence the advice to consult an immigration attorney for correct legal advice. Mostly you will be asked to leave the country and enter it again on a F1 after applying for one, in your country of origin. But now that you have already misrepresented your visa, the chances of getting rejected are higher this time around.

There are always things you can do! :)

1. If you leave the country and apply for a visa again, (which in my opinion is the best bet since it will hold of problems later),
a. Take your transcripts which show you are the best student.
b. Show lots of financial support.
c. Big smile and a pleasant demeanor are always helpful.

2. Talk to a kick ass, tough as nails lawyers who eats IIO's for breakfast, continue with the AOS process and switch over the EAD/AP ASAP!

3. What ever you decide from the above, talk to a lawyer before making decisions. It is very important to have a squeaky clean immigration record, and minor flaws can be corrected by swift legal actions. Find the best way to deal with this, after talking to a lawyer and then make up your mind.
