Hi Folks,
I started my H1B in Jan 1999. As of today, I've completed 6 yrs on H1B and have my 7th yr H1B with company A, already stamped. During the last 6 yrs, I've been outside US for 6 months due to personal reasons. So my total stay in the US is only 5 yrs 6 months.
My I-485 has already been applied thru company A but no EAD at this point yet.
My question is if I want to change to company B, can I transfer my H1B to company B and start working (as I dont have EAD which will take another 2 months to come in) ? How does INS consider the 6 yr stay? Is it the 1st H1B entry date + 6 yrs or equal to the total stay in the United States till we complete 60 months of stay.
Any info on this matter is appreciated.
