Just wanted to share my h1b stamping experience (Toronto):
My Interview was at 8:30 AM, Went in at 8:15, submitted
my passport,I-797,DS-156,DS-157,The interview letter sent by embassy ,the receipt from the Scotia bank at the counter and was told to be seated. I was called at 9:30 AM,
Following were the questions and Documents asked:
Q: What's your native language,Do you speak hindi or punjabi?
A: I said Hindi.
(She gave me the DS-157 form because in one of the columns in DS-157, I was supposed to write my Full name in native language not in English. I wrote my name in hindi and gave it back to her)
Q: I need your canadian PR Card and when did you land?
A: Gave her the PR card and said 2 months back.
Q: I need your, Letter from employer, Pay Stubs ,I-129 and LCA?
A: Gave her the whole bunch.
Q: For how long did I work for this company
A: 2 Months.
Q: When was that?
A: Nov last week (2002) to Jan last week (2003)
( I had pay stubs till feb 2003)
Q: After that?
A: I said, I had to go to india to get my canadian immigration as I had applied in India and that took some time.
( She reads the letter from employer carefully ( Almost for a minute) flips through I-129, I-797,LCA and Pay Stubs )
Q:So if you go to US now, won't it affect your PR status here in canada?
A: I didn't know what to answer exactly here, so just explained that my family will be here in toronto and I will be in US
till my h1b is valid.
Q:What does your wife do and what's her status in canada?
A: Studying and she is a Citizen.
Q: Is She travelling with you?
A: No.
(Checks my passport and checks my old h1b visa stamp which has expired)
Q: Which company did you work for earlier?
A: I said the company name.
Q: How long?
A: around 2.5 years
Turns the DS-156 Form, I had a refusal(221-g) once (h1B visa) at delhi counslate last year.
Q: Why were you refused visa earlier?
A: I explained the reason.
Q: Is this the same Company you are applying visa for?
A: I said No. I quit that company.
Q: Where did you study, US or Canada and what have you studied?
A: I have done Bachelors Degree in Computer Science Engineering from India.
Q: Can I see you'r Degree Certificate and Transcripts?
A: I give her the Full bunch, she carefully goes through the Degree Certificate.
That's it,It was almost 10 minutes ,she makes few notes on DS-156 form and gives me the white/Red Slip and tells me to collect the passport tomorrow and returns all the documents except I-797.
I got the passport stamped.I suppose even though your case is complicated, if you have all your documents in
place,things should work out but still sometimes luck also depends.
( Also one more thing to note was they didn't collect Reciprocity fees)
