My company gave the attorney their W3 for 2004 but no tax return form;
the W3 and tax return form 2003 as the company ability to pay (response to RFE), but the attorney says he doesn't know what is W3 ; he is feeling reluctant to send them to uscis. Please I need help, can someone get an approval with the W3s of the company? It is a small company. What can I do? I don't want to get a denial. Thanks in advance.

what is your priority date?
did you get paid proffered wage from priority date?

w-3 only shows total amount of wages paid for everyone by the company. it doesn't help in proving ability to pay.

If 2004 tax return hasn't been filed yet, then you can submit the extension request to file.

Hi UN,
I had delayed my FP and had gone and done my FP after 3 + months. I applied in August 2004 and did my FP in December.The Center allowed me to do so.
I received "processing resumed" for my FP after 1 week. Would that delay my case?
would be grateful for your reply..
