Hi everyone,
My brother is on F-1 visa here and last Fall semester (2004) he took an online course that he didn't complete and somehow the instructor "withdrew" him from the course. As a result, out of his 12 credit load he only completed 9 credits. This january (Spring 2005) his school informed him about him
being out of status. He then applied for re-instatement which got approved on the 15th of May 2005. His new I-20 says "Re-instated...D/S"...Now the problem is, this december we intend to visit our country and it would be his first time going out of the States after this incident. I am a little concerned about him being illegally present for more than 180 days during the process of his re-instatement. The reason of my concern is that I am not sure as of what date he was considered out of status.

1. Was it in december 2004 at the end of his Fall semester for not being able to keep full time status?
(More than 180 days)

2. Was it this january when his Spring 2005 semester started and his school informed him about his status?
(Less than 180 days)

3.Or was it when the school informed SEVIS about his status? (Not sure of the date but could find out, it would probably be within 30 days from the start of Spring 2005 semester )

I am very confused and concerned. I pretty much looked through the entire USCIS website but could not find a proper answer. I would greatly appreciate everyones help in this matter. Thank you all so very much for taking time in reading this thread.
