I know in the past we had some disccussions regarding V visa and you sent me to another web site (BritishExpats). Anyway, just wanted so see if you have any idea what is happening with the V visa or if anybody knows. Thanks guys (or gals) :) .

Hi nofreedom -

Sorry it took so long to reply - am out of town.

I believe the V-visa has sunsetted/expired and a renewal of it (with some improvements) are pending in congress. The original V-visa was part of the LIFE Act. I know the renewal of this visa is looking at reducing the waiting time to file from the orignal 3 years to 6 months after an I-130 has been pending.

Here is the CIS link to the original V-visa

Here are some links of bills that are currently out there for eliminating the need for a V-visa. Most of these are very interesting and will definitely make our lives easier if they ever pass. But isn't that just too cheerful for CIS?!

This last one specifically address the V-visa situation

Ok..anyone else heard anything new about the whole V-visa situation?

thank you LolaLi, as ususal always full of good info. Well this is my only ticket. My wife is still F-1 and the school cost is killing us. My GC is still somewhere on somebody's desk who doesn't care if you have family or not.

Anyway, happy new year and I will look over these proposals. Hopefully by the time I get my GC, some of these will pass.

well, it would be nice, but it is hard to find an employer for her when we are planing for the family at this time. I'm not gonna wait for mercy from USCIS. I want to start family now. So, I guess I just have to find some other way. I hope you understand. I've been through a lot in my life and I just don't want to wait anymore.

Once i asked an immigratian attorney about Marrige of asylee to another status immigrant .He told me it is hard but it is possible to solve in positive way .Did u talk about your situation to any immigration lawyer?

A new Congress convened this week. All the above bills died with the previous session of Congress. They will need to be reintroduced. The prospects for pro immigrant legislation at the present time are not that good.

Gilbert -

I thought the V-visa had an expiration date... Is it still out there and available to LPRs (who were former asylees)?

Gilbert, I understand it is for LPR, however, I did not find any specification what kind of LPR. So, after I get my green card (RD Dec 28,99), and assuming they change the law, my wife would be able to apply for V visa. I hope this is correct statement. If you have any other info, let me know.

LolaLi, V visa expired on December 21, 2003
"A person may apply at a U.S. consulate abroad for a V-1 or V-2 visa or seek V-1 or V-2 nonimmigrant status while in the United States, if that person is the principal beneficiary of a relative petition (Form I-130) that was filed by the Lawful Permanent Resident spouse/parent on or before December 21, 2000 ...."

There was no need to post a question over and over.
