hi,
I am a pediatrician whose perm just got approved. Still waiting for the hard copy. To apply for 485 before retrogression, I also prepared for self filing NIW I 140 ( for the same job, since this is a MUP area as well. ) Now, I never been on J1. I am planning to apply though NIW eb2 for physicians before sep 30. Now, once I get the hard copy labor cert, I am also planning to apply for I 140 with approved LC. Is there any way I can interfile the 485 with labour I 140? Because then I do not need to stick on with HPSA areas and can use portability act and leave the current employer ( he makes me to be on call every single day). Will the INS get confused and reject the 485? Also, If I move to a different HPSA area, do I need to amend a new I 140 and does the 5 yr clock starts from the second I 140 or after the first I 140 approval?

I do not think it can be done. If your labor cert I 140 is approved, and your green card number comes up via the NIW I 485 then you can use the I 140 from labor cert and adjust status via the NIW 485. But you cant just file labor cert I 140 and NIW related I 485.

A new I 140 has to be filed if you move to a different HPSA area. By the way you can open your own clinic too in HPSA/MUA/p area. Just make sure you check with your state dept. of health that for giving you a letter of support for NIW will they require you to work in HPSA/ MUa/p. If you move to a different state, then make sure that that state health dept. will issue a letter of support to you for NIW.

From what I understand the 5 year clock should start ticking from the approval of the first I 140.
