To File or Not to File

I had my citizenship interview on April 20th,2006.I passed the tests and like everybody else here stuck in the namecheck black hole. My 120 days coming up in August 20th. I am contemplating as to file a petition 1447(b). I like to know what you guys think, would it be wise to do so?Or it may complicate things even further. I would appreciate any advise.

BTW, Do you guys know any good lawyer in Phoenix Arizona who has done this before.

P.S. What do you guys think of writing a letter to General Counsel, Director of District and the DA letting them know that I intend to file petition 1447 (b) if my case hasnot been resolved when 120 days run out.

just go ahead and sue them before they change the law...plz dont hesitate...as long as u have not commited any crime u do not deserve to be held/

What makes you think that everybody gets stuck in "name check" problem? This is totally inaccurate. A large majority of the applicants go through fine. The name check issue is clearly in the minority.

If I were you, I would definitely file for 1447 immediately after 8/20.
 
Thanks for the replies. I meant everybody here. Obviousley those who didnt have this problem they wouldnt be here posting on this forum. What do you guys think of sending a letter prior to filing the petion showing my intent?

I am interviewed at the exact same day in North California. I have similar feeling. Howevre, I think I am mentally ready for the lawsuit. I think there is no reason to wait for more. I believe with a lawsuit, we should learn the result of the case within a known time frame. Otherwise, we will wait forever. Altough, there are many succesful cases on this forum when people file it pro se, I feel I will hire a legal profession to handle it for me. However, I envy and proud of the people on this forum who file the lawsuit pro se. Good luck to you and myself.

I really have no idea why you are making an assumption that all those are posting here have been going through name check issue. That's simply not the case. Many people, like me, are posting here because of two reasons -

1) They want to keep themselves posted about how other guys' cases are proceeding
2) They received help when they were going through the process and now want to give something back to the community - simply sharing knowledge.

Certainly I believe there are more likely to be people posting here with problems - after all if every case sailed through, this forum wouldn't exist - but there are many many people who are processed without issue. From what I've seen, the Baltimore DO holds oath ceremonies daily, with average attendance around 50 people. Thats 250 new USC a week in Maryland alone... clearly they are not all stuck in namecheck.

My own case was one of those quick ones - applied February sworn in July, and my wife will be sworn next week.

My reason for posting here is simply to give something back to the community. When I feel I no longer have anything worthwhile to contribute I'll stop.

agree,i had no issues with name check either...just tht i had to go through some horific moments initially...thought it might help someone..
