My Priority Date just got current and would like to get some advise before I file my required documentation to USCIS for both I-140 and I-485.

1) How long is the current I-485 processing time ?
2) Is it wise to file my I-140 in premium where by paying $2800 along with I-485 or will it be waste of money since I-485 anyways takes lot of time ?

Please guide.

Congratulations on your Priority Date becoming current! Here's some advice for filing your USCIS documentation:

  1. I-485 Processing Time: The current processing time for I-485 can vary depending on your category (family-based or employment-based) and the USCIS field office handling your case.
  2. Premium Processing for I-140: Since your Priority Date is current, filing I-140 in premium processing might not be necessary. Here's why:
  • Focus on I-485 Processing: The I-485 is where the longer wait lies. Expediting the I-140 won't significantly impact your overall Green Card timeline.
  • Cost vs Benefit: The $2800 premium processing fee can be significant. Unless there's a specific reason you urgently need the I-140 approval (such as a job offer with a tight deadline), it might be best to save the money.
Alternative Strategy:

  • File your I-485 concurrently with your I-140 (if eligible). This can potentially speed up your overall processing time.
  • USCIS prioritizes employment-based adjustment of status applications during processing.
