Hello:

I have an approved Labor from State (CA) and Federal labor is in the "Philly Backlog Center" still pending. No updated status from them yet.

My Priority date is: Aug 2002

My 6 years of H1B will be ending in May 2006.

Based on the above I have few questions:

1. Is there any way to find the status of my federal labor? Any phone number or email or web-site or can the attorney find out?

2. Does it make sense to file PERM at this time with the same employer or it is not allowed ? Also, does it make sense to lose out on this petition?

3. If I file PERM with a new employer, can I retain this(my old) PD?

4. What should I be doing? It is getting frustrating at my current job, since it's a small start-up company.

5. Does it make sense to change my job at all at this point? If I change the job in Nov, can I get an extension of my H1B (6 years expire in May 2006)?

6. After getting my 7th year renewal can I change to a new job?

Any advice on what road I should be taking to move ahead

All this is very subjective. My advice:

Rough it out. You already have a GC process going on for 3 years. You can't change employer and expect to file a new LC with the same PD.

Even if you change you job, what's the gurantee that the new job will be more satisfying? I work for a Dow Jones-30 company.... and it's frustating.... but I still want to be done with my GC for once and for all.

I know a person who original filed his application in 98. changed jobs in 2000 and then again in 2002. Now he -way past the 6 years limit- is slaving away waiting for GC -WITHOUT any option of changing job now. You don't wanna make the same mistake.
