To Bhanu and others . How do i know I485 filed on EB2

Could you please tell me , how to find out my I485 have been filed on EB2. My I140 got cleared on EB2 category. I cant ask my attorney since she is company\'s attorney she wont answer our questions. Do you have any suggestion how to find out..

You can call INS and find out about that or you can ask(you have the right) your attorney to provide a copy of the I-485 application.

It\'s odd that the attorney won\'t give you the details. However, I shall check my records and let you know how you can find out. I think, the LCA or the I140 petition should tell you this and if not the best way to find out is to call IIO. But I shall let you know.

simple, check ur I-140 or labour approval letter, if it says "SKILLED WORKER" you are EB3 if it says "EXTRA ORDINARY SKILLED WORKER" you are EB2.

I think you got your answer... But I think if your LC/I140 are approved in EB2... to my knowledge attorney will have no choice but to apply in EB2 - otherwise it might get an RFE... am I not right? I guess you could trust your attorney.

Also if your I485 is applied and is accepted by INS - that means your date is current and EB2 or EB3 doesn\'t matter anymore - isn\'t it (except that in future they may retroggress the dates and stop processing your).

Even though your 140 approval notice says EB2, 485 might be in EB3. Take my case. My 140 was approved in EB2 after a in 140 stage. The RFE was to change the category to EB3. My lawyer said okay to change to EB3 (BS+5). But the approval notice said that 140 was approved in EB2. I spoek to IIO and got the confirmation that 485 is in EB3. Not all IIO know to check this so you might want to talk to few. If your 140 was filed in Feb98 and approved in Aug98 after a RFE you might want to check. Are u from R----M company in pittsburgh?

My 140 approval notice says EB2. But my 485 is in EB3 category. During my 140 stage there was a RFE to convert my category to EB3 (BS+5). My lawyer said okay to convert to EB3. But my 140 approval notice said EB2. I went ahead and filed my 485 in OCT99. Once I had called IIO and he mentioned that 485 is in EB3 Category. This happened in Nov00. Not all IIO know how to check this s, so you might want to talk to few. Now INS (IIO) says that my 140 EB2 appporval notice is printing error. Actually my 104 was approved in EB3. So talk to IIO and get it clarified if you had a RFE in 140. Are U from R_____M Company from pittsburgh(C____PE)

Thanks for all input.. Bhanu .. I know my I 140 cleared on EB2 . I am worrying about my I485 application.

For all ,

I have applied mid Dec 1999 (RD ) and My ND is Beg Jan 2000. I spoke to IIO twice but as some one said , I got message stating if you file in EB2 then it is EB2 . But I never got the answer it is in EB2.

I have copy of My I 485 application. Is there any way to find out from that.

Some one quoted it does not matter whether EB2 or EB3 . but it matters since if it is EB3 my PD is not current
