To Be In Status, Or Not To Be... That Is The Question :)

I know how most of you hate to read long messages, so I will try to keep this as short as possible. An American male married a filipina in the Philippines, then brought her to the US, on a B1/B2 visa. Later he filed for an I485, so that she could get her green card. I ran an ad and hired her as a housekeeper. Her husband is sort of a playboy, so he left her and went to Mexico, to be with another woman, and then to the Philippines to be with another one. A few times he came back to the US to be with her, and then he was off again. There have been many meetings scheduled with USCIS, but he was never in the US at the time for them, so for the past 3 years she has been in limbo, but not out of status. Finally he filed for a divorce a few months ago. A couple weeks ago she got a reply that her I485 was denied because he hadn't shown proof that he was divorced from his former wife. So now she is out of status, and I understand that there is a 6 months deadline before she is out of status to long to do anything.

Anyway, she has been working for me and renting a room, which over time has developed into a relationship, so I would like to marry her. Officially, her divorce will be over two weeks before her six months out of status is up, but as with most government dealings, someone could drop the ball and it be delayed. So I am looking for ideas to delay her in status just a short time by filing something. This is definitely not the typical situation where she is just trying to get a green card, and after being together for over 3 years, it is pretty obvious that we will be together forever, even if she has to go back and I have to go get her again, though I am trying to avoid that scenario.
