I got an RFE for employment letter and my details are: NIW employer sponsored; applied for I-485 and later got laid-off (employer didn\'t withdraw the I-140); currently employed in the "SAME FIELD". So, responded to the RFE with current employment letter. I consulted my case with so many lawyer\'s and as per them: as long as I am in the "SAME FIELD", which got me the NIW, employer doesn\'t matter!! Well, have you guys seen (or heard of) any case like mine got approved (after the RFE)? Could you please share your thoughts? Thanks in advance for the help.

I am not sure about this ... as far as I understand, if the "petitioner" field in the I-140 has your old employer\'s name in it, you lose the 140 along with your job. I know this for a fact when it comes to EB1-EA petitions.

I\'m in the same boat, my NIW was employer sponsored. And I filed my I485 with my new employer\'s letter. No RFE yet, but waiting.
I consulted quite a few lawyers too, and they told me the same story. Somehow, I feel we are at the mercy of the INS officers who deal with our cases.
Good luck, and please keep us posted

My I485 ND is 2/28/00. I still have monthS to wait. I was thinking about redo my I140, but my lawyer felt it\'s not necessary, and I got lazy too. Good luck to you again.

Mandy
