Guys,

I heard a lot of frustration in guys who filed just after
April the 15th. I know your frustration as I\'m one of you.

From my continual experience, the INS works in batches that
can last for a week to a few months. Hopefully
our approvals will be in this latest batch of approvals
but don\'t be surprised if we aren\'t included
or only some of us are.

It happened to me when I filed for my H1 transfer. I filed
on the 20th of the month. People who filed in the first week
of the month got approval after about 2 months. I took six (6)
months to finally get my approval. CSC just deprioritized
H1 transfers to work on new H1\'s. CSC did this to catch upto
to the other service centers for H1 Cap reasons.

So as they say, hope for the best, prepare for the worst.

Same problem with my 485

Few of my co-workers applied for 485 after me received notice before me.
Couples of weeks difference. Delay in this ND screwed up my FP, still waiting for FP (SJ).

Unfortunatly my company is closing down in Feb 2002 (Chapter 7) !! Very sad situation.
 
Bongo, I know that H1-transfer thing ...

It happend in Spring 2000 when INS was concentrating on new H1. It took 6 months to process an H1 transfer and only 2 months for a new H1! Funny. Some of H1 transfered guys got crashed. They exchanged ideas on killing time and enjoying the life. I was moved to see they are so nice to each other (on the predesessor of this BBS).

At that time I was anxious to get my new H1 since my wife depended on it to come to join me. Her F1 and B1 visa apps had been rejected for 6 times before that! The good thing was, it was a new H1, the fastest case :)

It\'ll still be ok if we get included in the next batch...

But sometimes INS works in weird fashion where they\'ll simply jump some period and start approving the later cases - I\'m not sure of the dates but I remember reading postings on this Board earlier.

Also, looking at ND vs AD analysis on Ciba\'s site - I found this case - see 2000/07 ND, 2000/08 ND and 2000/09 ND approvals. large no. of 200/09 ND approvals came in 2000/12 while significant no. of 2000/08 ND were still waiting.

Also if you see approvals in 2000/07, only 9 (out of total 75) were approved for 1999/08 ND but 19 approvals were sent out for ND 1999/09-2000/01.

I only hope it doesn\'t happen to May/June ND guys. And we guys get approved in sequence, as far as possible, whenever that happens.

Right.

The INS were approving lots of cases with ND\'s in 2001 but
had not approved lots of cases with ND\'s of 1998.

There were various petitions from guys with 1998 ND\'s
who got together and wrote
a strongly worded letters to the INS (with the help of their
laywers). I guess that helped the INS to get back to processing
1998 cases.

I think the INS sometimes just forgets!

If they forget our case we must kick up a big fuss like the
98 ND guys did. I hope it doesn\'t come to that.
