TN - Slightly Complicated Issue

hello all,

I will probably discuss this issue in detail with a lawyer as well, however, any feedback on this will be highly appreciated.

I studied in US for two years as an undergrad on a different country's passport. I then transferred to a Canadian University, got Canadian immigration and eventually Canadian citizenship.

I got my first TN last year (2006), had absolutely no problem getting it, however, I left just after two weeks for a better opportunity in Canada. I came back to US just a few months back to attend graduate school. Getting an F1, however, was a painful experience, as the officer who handled my case was really picky. I was very open during the questioning and declared my stay in US for education (which they did not have any record of), however, I was denied an entry on the basis that they wanted to see my old passports. I was photographed and fingerprinted. I went back, got the documents and got the F1 the same day. They verified everything that I had told them, and it was all true.

Now I have found a job in US, and am planning to go for a TN soon, which means that I will either be studying part-time or not studying at all. What kind of questioning in regards to 'immigrant intent' or otherwise can I expect? I will try to get the documents as perfect as possible, but should I take a lawyer with me?

It shouldn't be a big deal. You need to work to make money so you can go to school, right?

hopefully, but I am still worried, as I may not have any other option to pay for school.

I will take the precautions, but wold it be better to take a lawyer with me?

If you're worried simply about the immigrant intent issue I suppose I would make sure to have documents showing CDN residence, ties (ie Loans, Bank Accounts, etc), etc. Something that indicates you would have something to return to.

I would also point out the fact that you have previously studied and worked in the US but always returned to Canada and never took any actions toward permanent residence or immigration.

Be honest and open, dont try to outsmart anyone, answer their questions with truthful but simple replies.
