This is my first renewal for TN due in June.

I am driving to the border.

Still working for the same employer, how does the offer letter and TN Petition should look like, exactly like it was for the first time?

Should it mention some where on the offer letter that it’s an extension of the employment for another year? Should it exactly look like that it’s a new job?

Please give me some suggestions, and advise me that what are the best time (during the week) / border to go for (Fort Erie, Queenstion Bridge?)

The last question in this thread I have is I am currently on TN with one employer and another company offer me to do some teaching.

Is it possible that I can work for them on 1099 (Self Employed).

Do I have to get any sort of permission from immigration first?
Do I have to register my business so I can without that as well?

Can my dependends (TD holders) can also do some sort of work on 1099 (self employed)?

Is this restriction not working as a self emplyed only in the TN category or thats applied on H1 as well?

I am asking because I know somebody who is on H1 and working as a Self Employed as well as an employee.

in other words, he is working as an employee for Company A who sponsor his H1 and working self employed (consulting business) for some other companies.

Is it permitted in H1 category?

I also knew someone who did this on a TN. He got a way with it for a few years (at least 5), then we lost touch. As Brian mentioned, its not legal, so when they catch up with him, he may get in trouble, although I'm not sure what the penalty would be. This individual was not planning on staying in the US long term, so he didn't seem to care if he got caught.
 
OK let’s take this scenario.

I have registered a company A, and got some work from Company B, I hired contractor and send the bill to Company B for service. Then I pay the contractor and whatever the difference I got I deduct the expenses and the extra amount I showed in my tax return.

Is that legal / allowed on either TN or H1?

Let's use specifics:
You registered company A as a cleaning service. You need a cleaning lady (contractor) to come clean your client's house (company B). Company B pay company A for the services. Company A pays the cleaning lady and keeps the difference.

At the end of the year, Company A pays you. Company A needs to file taxes for it income, and you also need to file taxes for your income.

Did I get it right?

So far this is legal....As long as you were not in the US when this occurred or if you never interacted with Company B or the contractor which is outright impossible without having hired another person just to run Company A.

Somebody had to write the check to the cleaning lady, and somebody had to write an invoice to company B. Somebody had to find the client and somebody had to actually find the contractor. Not to mention, somebody had to take the paperwork to an accountant to file taxes, and/or keep a general ledger. Those processes and interactions, however trivial they may sound, could be considered "work" by the USCIS even you never get paid, and you can't work legally in the US unless you have a work visa regardless of whether you get paid or not, and the USCIS will not issue you a H1b work visa or TN work status for a company that you are the owner of, as Brian mentioned.

For that purpose you would need an E investor visa, but that's not easy to qualify for unless you've got a hefty amount of liquid assets.

I just notice that I have nothing which specify my ties in Canada, what sort of document I can take with me to the border?

Currently I have my educational docs, officer letter and TN Petition.

What else?

What I am missing here?

A permanent address in Canada. They will ask for that on the I-94.
 
What is the self employed route????

I do have a permanent address in Canada, my appartment is still rented, but do not have a current mortgage statement, I print it from the RBC website, will that sufficient??

In the previous few posts, you asked about company A and Company B and how you can work around the law to sponsor yourself by what essentially is "self employment". I assume you are not going to do this, after all the advice Brian and I gave you.

This should be enough. I've never heard of a TN getting denied because of a lack of ties, unless an I-485 had been applied for in the past.

Dear friends,

I have almost completed one year working under a TN Visa. Employer is willing to give me the letters for renewal. It’s been a very interesting experience and I would like to take advantage and complete some of the things I could not finish, I think I could do it in a couple of months or so. Only drawback is payment, it is not that great. As TN visas are employer exclusive and I will like to find another thing in the near future and not be too much attached to my present employer too long. I wonder if it would be more advisable to renew only for a certain period of time let’s say 6 months instead of the whole year?, I wonder if that is possible?, if so, will I get multiples entries on the visa under this circumstance to move back and forth from US and Canada. I heard it’s more difficult to ask for another TN visa while you are currently working currently with one, and in some cases immigration officers cancel the present TN because the person wanted to get another one or change his present employer before the ending of the former one. I wonder is that is true?

I appreciate some advice concerning that.
