TN Qualified???

I am currently in the US working, and on a H1B visa. I have been offered a new position and the employer will not transfer my H1B but will give me a letter of employment so I can obtain a TN. I have been in the US since 1999 and prior to this May I had been on TN visas (Canadian). I have been researching the current requirements for a TN and am not sure I qualify: I have a BA in Communications, A Diploma in Information Technology - 9 month course that was condensed from 2 years but has 2 years of study hrs. 5 years work experience in US Would I qualify for a TN visa with these credentials? I have previously had them but would hate to get to the border and discover I did not qualify due tochanges in regulations Thank You.

Generally, the legal requirements for NAFTA have not changed since 1999. However, there has been a serious clamp down on applications in the Systems Analyst, Management Consultant, and Scientific Technician categories. Any applications in these categories should be done through a lawyer. They routinely get rejected. You should post this question, along with a few more details on the Immigration board at www.grasmick.com. This message board deals exclusively with Canadians and the issues with TN's comes up a lot.
