hey guys,

I have a question regarding switch to H1 from TN.

Which visa do you think is more appropiate and beneficial. Currently, i am on TN visa and my employer has agreed to apply H1 for me. After his acceptance, i am little confused if i should switch or shall i continue to renew my TN every year.

Now supposedly, lets say i get H1 for 6 years and then i want to convert back to TN...Is it possible or would i have any trouble doing that.


Any opinion/suggestions will be greatly appreciated.

Personally i perfer a TN over a H1 because it is much easier to deal with if and when you want to change jobs or take a second job. Further it is completely possible to transition from a TN to GC without ever having a H1.

Can you tell me how are this processes under TN ? I was thinking to get H1B...because could be easier to get green card...

I am on TN, and happy with this. My husband's company is doing the GC for him. So I will keep renewing my TN, but up to what point I should be added to My husbans' GC process?

When your husband files the I-485, as you are his dependant, he should also file an I-485 for you as well. At the same time he should file for you an Advance Parole I-131, EAD I-765, and an Affidavit of Support I-134, all at the same time when he files his I-485.

Once an I-485 has been filed for you, you should not travel until you get your AP in your hand, and as well, you should not apply for another TN ever again.

Last time I only read your brief history. This time, I printed all 20 pages and read all the steps. You really helping a lot on this Forum.

One more question, In March 2002 you filed you TN renewal. April 2002 you filed your I-485, June 2002 you received your TN renewal. Which means when you file your I-485 you do not have a approved TN renewal yet. So when CIS gave the appoval they did not notice that you filed I-485 in Apil 2002? Is it just by luck, or is it because you filed TN renewal earlier than file I-485 so no problem?

When I filed my TN renewal in 03/2002, I still had a valid TN, that would have expired in late 06/2002.

I'm sure they noticed, but there was nothing wrong, because I filed the TN extension BEFORE the I-485 application, and everything was ok.
