Hi,

Here is the scenario. A guy is on TN full time. He started a business part time with another person (US citizen). He didn't draw any income in the beginning. I assume that no income means no TN required, right?

Later on, it is doing ok. He drew a little bit income, say $4,000. It probably just covered the expense, e.g. computer and office equipment. Does he need a TN now for this income? Can he get one if he is the co-founder?

After this, he decided to starting his own business alone. He may or may not hire employees. Can he get a TN through his own company?

1. You cannot self sponsor for a TN
2. If you own a business you must be an "arms length or silent partner" - no decisions about the business no work at the business.
3. See #1 above.
You have to be employed in a position that is a match against the TN list.
If you are investing, and it appears you might be, then you need a different, EB, visa.
If I were you I wouldn't go any further with respect to the current business you have or starting your own as neither one can be covered via a TN work status.
